1.1 Introduction. Welcome to OnMyBubble.com's online digital goods exchange (the "Site"). These Terms and Conditions (including any documents referred to in it) ("Agreement") list the terms of the agreement between you ("You") and OnMyBubble.com ("OMB" or "We" or "Us") for the buying and selling of digital goods ("Product, Services and Subscriptions"), and all other services that We provide (the "Services"). By using our Site, You agree to accept this Agreement.

1.2 Digital Exchange. OMB provides a service that allows members who want to buy Products ("Buyers") to find members who want to sell Products ("Sellers"). OnMyBubble.com does not take title to the underlying Product, and the actual transactions are between the Buyers and Sellers. Once a Buyer and Seller have entered into a transaction, all transactions are covered by the OMB Guarantee.

The fee charged for downloading digital products is a fee for the service of downloading and having access via your unique profile page to the digital item. This includes a charge for hosting and serving your pages and may include a repeat charge for multiple downloads where the item is subject to a limit. Download limits might be imposed for large documents. Time limits may be imposed for access to premium content such as games, which may require repurchase of tokens to acquire more time.

1.3 OMB Guarantee. When you purchase Products on OMB, OMB guarantees that you will receive the Products you paid for within a reasonable time frame (digital products are typically available within a few minutes of the transaction taking place but may take longer depending on the speed of third-party services used to support the back-end of the site).

In the rare instance that a problem arises and the original Product Seller or Service Provider (Merchant or Vendor) does not provide you with the Product or Service you expected (this might be because a link provided on the PDF file purchased is either broken or missing, or the "Linked Service" is unavailable or not as described in the product listing details on the Site and other marketing materials), OMB will, at its sole discretion, review the facts and offer you replacement Products at no additional cost, where possible. Alternatively, OMB will issue you a refund for the cost of the Products less any payment processing transaction charges.

"Comparably priced" replacement Products are determined by OMB in its sole and absolute discretion. When you sell Products and Services on OMB, provided you provide the exact Products listed for sale and the Product Buyer successfully takes receipt of the Products or accesses the Service, OMB guarantees that you will be paid for your sale, subject to any charge-backs which may lawfully be made subject to the terms and conditions of PayPal or other payment processor the site uses. OMB will take a commission based on the category of the item listed. In cases where OMB hosts a linked product or service such as a game or app on our servers, we may vary the charge to include a hosting fee based on separately negotiated terms.
